Rental Agreement

Below is the Pond Retreat rental agreement. Guests will be prompted to accept these terms on the reservation booking payment webpage.

This Rental Agreement ("Agreement") is made and entered into by and between The Pond Retreat LLC, the Manager and Owner of the rental property located at 169 Walker Pond Rd., Sedgwick, Maine, Hancock County ("Property"), and the Guest ("Guest"). The Manager agrees to rent the property to the Guest under the terms and conditions outlined below.

1. Rental Period

The Guest agrees to rent the Property for the time period included in the reservation made through the Pond Retreat website. If this agreement is for an event, the rental period is limited to the agreed-upon event duration.

2. Rental Fees

The Guest agrees to pay the total rental fee included in the reservation, inclusive of applicable taxes and service fees.

3. Property Use

The Guest agrees to use the Property only for lawful purposes and in a manner that respects the rights of others. The Guest will ensure that all attendees at the event or guests staying in the property follow the same rules and regulations as outlined in this Agreement.

4. Liability Waiver

  • Acknowledgement of Risk: The Guest acknowledges that staying on or using the Property may involve certain risks, including but not limited to slipping, tripping, and other personal injuries. The Guest agrees to voluntarily assume all risks associated with staying at or using the Property.

  • Release of Liability: To the fullest extent permitted by Maine law, the Guest agrees to waive, release, and discharge the Manager, their agents, employees, and any other affiliated parties from any and all claims, demands, actions, or causes of action arising out of or related to any personal injury, property damage, or other losses sustained during the Rental Period, including but not limited to injuries resulting from accidents, events, or acts of negligence, even if caused by the Manager's actions or omissions.

  • Indemnification: The Guest agrees to indemnify, defend, and hold harmless the Manager from any and all claims, damages, costs, and expenses (including legal fees) arising from the Guest's use of the Property, including any injury, damage, or loss sustained by the Guest or any third party during the Rental Period.

5. Use of Boats, Water Activities, and Risks

  • Boating and Water Use at Own Risk: The Property may include access to boats or other watercraft. The Guest understands and agrees that the use of any boat, watercraft, or water activities (including swimming, fishing, and other aquatic activities) is entirely at the Guest’s own risk. The Manager does not assume any liability for injuries, accidents, or damages that may occur while using the boats or engaging in water activities.

  • Waiver of Liability for Water Activities: The Guest hereby agrees to waive any and all claims against the Manager for any injury, damage, or loss resulting from the use of the boats or engaging in any water-related activities. The Guest acknowledges that water-related activities carry inherent risks, and it is the Guest’s responsibility to take all necessary precautions to ensure their safety and that of others.

  • Safety Requirements: The Guest agrees to ensure that all persons using the boats or engaging in water activities wear life jackets and follow all local safety guidelines and regulations. The Manager makes no representation or warranty regarding the safety or condition of the watercraft or the water activities.

6. Damage to Property

  • Guest Responsibility: The Guest agrees to be responsible for any damage to the Property, whether intentional or accidental, during the Rental Period. The Guest will notify the Manager immediately of any damage or issues.

7. Alcohol, Drugs, and Behavior

The Guest agrees to comply with all local laws regarding the consumption of alcohol, illegal drugs, and other controlled substances. The Manager reserves the right to terminate the rental immediately if any illegal activity occurs on the Property.

8. Cancellation Policy

  • Vacation Rental & Event Cancellation by Guest: If the Guest cancels a reservation, the following refund schedule applies:

    • 50% payment due at the time of the reservation is non-refundable.

    • No refund of the remaining 50% balance due if cancelled less than 7 days before the check-in date.

  • Cancellation by Manager: The Manager reserves the right to cancel the reservation at any time for any reason. In this case, the Guest will receive a full refund.

9. Pet Policy

  • Up to two (2) well-behaved pets are allowed for a flat pet fee of $100 per stay. Pet fee does not apply to service animals. Please disclose pet or service animal details upon booking.

  • Pets must not be left unattended in the home unless crated. Pets are not allowed on beds or furniture, so please bring a pet bed or crate.

  • Please clean up after your pet immediately in the yard and common areas.  Place bags in the outdoor garbage bin.

  • Pets must be fully housebroken and flea-free. Guests are 100% responsible for their pet's behavior and any damages to the property.

  • Pets must be kept on a leash at all times while on the property's exterior grounds.

  • Please bring your own pet bowls and disposable bags.

10. Additional Terms and Conditions

  • Smoking: Smoking is prohibited inside the Property.

  • Noise: The Guest agrees to adhere to local noise ordinances and keep noise to a minimum, especially during the late evening and early morning hours.

  • Subleasing: Subleasing the Property is prohibited.

  • Access by Manager: The Manager reserves the right to enter the Property for purposes of inspection, maintenance, or emergencies with prior notice, unless an emergency requires immediate action.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Maine, including the laws of Hancock County and Sedgwick, Maine.

12. Severability

If any part of this Agreement is found to be unenforceable, the remainder of the Agreement shall remain in full force and effect.

13. Entire Agreement

This Agreement constitutes the entire understanding between the parties. Any amendments or modifications must be in writing and signed by both parties.
